The Competition Tribunal lost two key regulators recently. Liberty Mncube, former deputy chair and an associate professor of economics, moved to consulting firm Berkeley Research Group as a managing director in October. Yasmin Carrim, a full-time member, resigned to become an acting high court judge. Two part-time members also left after completing their terms. “There has been a consistent exit of important people from the tribunal,” according to a competition partner at an international firm who did not want to be named. Filling the void with part-time members has not helped, they added, “The part-time members are typically practicing academics and sometimes practicing lawyers, so they are not usually available for two to three weeks at a time for a big hearing.” The Competition Tribunal is speaking to top law firms about how they might assist with the regulator’s increasing workload but exactly how that would work remains a puzzle, partners familiar with the talks have said. The tribunal heard 199 cases in 2023, 40 more than its previous year’s record in 2022, and the caseload is expected to rise further. “They will have to approach lawyers that have done this for the past 20 years and maybe try and get them in for a year or two to come and rectify things,” one lawyer said.
