In our new IP INSIGHTS, Partner Keith Noe discusses a recent case between a construction contractor and an LNG developer, which highlights the critical role of a robust non-disclosure agreement (NDA) in protecting sensitive information. The dispute arose when Kiewit allegedly shared confidential details of Venture Global's LNG facility with a third party. A comprehensive confidentiality provision in their NDA allowed Venture Global to secure a temporary restraining order and ultimately reach a settlement.
