    ?Understanding California’s Voting Leave Law: Employer Obligations as Election Day Nears As Election Day approaches, California employers must ensure compliance with the state’s voting leave law, which guarantees employees the right to take time off to vote in statewide elections. ?Time Off to Vote Under California Election Code Section 14000, employers are required to provide up to two hours of paid time off if an employee lacks sufficient time to vote outside work hours. Time off must generally be taken at the beginning or end of the shift, and employees are expected to give at least two working days' notice if they need time off to vote. Polls are open from 7:00 a.m. to 8:00 p.m., giving employees ample opportunity to cast their votes. However, if work schedules interfere, they may receive paid time off for up to two hours, with additional time off unpaid if necessary. The law also allows employers to request advance notice and determine whether voting time should be taken at the start or end of a shift. ?Employer Posting Requirements In addition to providing time off, employers must comply with Section 14001 of the Elections Code by posting a notice informing employees of their voting rights at least 10 days prior to the election. This notice should be displayed in visible areas, such as break rooms or near-time clocks, to ensure all employees are informed. ?Serving as Election Officials Under California Election Code Section 12312, employees can serve as election officials on Election Day without facing disciplinary action for their absence. However, employers are not required to pay employees for this time. ?Steps to Ensure Compliance To remain compliant with voting leave regulations, employers should: 1. Post the required notice in a conspicuous location at least 10 days before the election. 2. Ensure employees understand their right to up to two hours of paid voting leave. 3. Inform managers and HR teams about the voting leave policy to handle requests properly. 4. Encourage employees to vote and remind them of their rights ahead of the election. ?Protecting Employees’ Rights Employers should also be aware that any retaliation against employees who exercise their right to vote is unlawful and can lead to legal action, including claims of wrongful termination. Employees terminated for taking time off to vote may have grounds for a lawsuit based on wrongful termination in violation of public policy. ?Conclusion California employers must take proactive steps to comply with state voting leave laws as Election Day nears. By understanding the legal requirements, posting notices on time, and ensuring employees can exercise their voting rights, employers can avoid legal issues while promoting civic participation.
