And so it is done. The people have spoken and immigrants and caught innthe backwash. A sad day to see the rise of nativism again. The had hoped that we had left eugenics and nativism behind in the ash heap of history, but apparently we are not learning from the past. Here is an inkling of why we are expect from an America Only immigration policy, 1924 redux. What Trump’s election means for immigration: Be prepared for H-1B changes. A lottery based on salary, increased filing fees, and increased enforcement against job shops. Look for higher visa denial rates and longer processing times. And count on no immigration reform, including no increase in numbers, no changes to per country limits, and even a likley shrinking of legal immigration numbers. The days of USCIS amazing out available numbers is over. Outside of employment based immigration, look for mass removal operations, temporary and massive detention centers, many arrests by ICE, stricter scrutiny at the ports of entry, student visa restrictions on OPT, STEM OPT, and a much higher standard for immigrant intent. Prepare for the formal end of DACA, the termination of virtually all TPS programs, the end of asylum as we know it, the end of our refugees programs, and a slow walking on the diversity lottery visa issuance. Every dream of restrictionists is about to come true.

The thing with Elon and his immigration status is that he holds others to a different standard than he holds himself. Immigration laws are complex and problematically obscure, and do not reflect lived reality. That said, when you want others to obey laws that you did not, well, you should expect criticism and scrutiny. Elon is in the perfect place to advocate for common sense fixes to immigration law, but does not. So, there you go. "Charles Kuck says Musk stating that he had a J-1 visa makes it clear he worked illegally, given the restrictions that would have only allowed work in connection with his academic program. So clearly, he’s admitting now that in fact, he did work illegally and violate his status. The only question is at that point, what did he do to fix his status violation?” Kuck says. Working illegally isn’t a crime, Kuck says, but having done so would require certain steps to be taken to return to a legal immigration status. This photo is so worthy of a share… I’ve had a client for several years now, and we have been through a lot to try and get him to the finish line. He’s nearly there, but already took the time and effort to have this amazing creation made for me in his home country. His sister just brought it with her while visiting, and he brought it to my office earlier this week. Absolutely amazing and so thoughtful! I’ve been working with him now for nearly 10 years - he had been reporting on an OSUP for far longer than that, based on a very old removal order. Well, after many years of accompanying him on ICE reports, he now has an approved I-130, an approved I-601 waiver, a reopened and terminated removal order based on very old procedural errors and positive equities, an approved c9 EAD, and a pending green card application with USCIS cleared of all grounds of inadmissibility. It has been immensely rewarding helping this client, especially now that he is also married and they have three beautiful babies. #KuckBaxter
