On March 18, 2025, the Second Circuit affirmed a district court’s order dismissing a putative class action complaint challenging the advertising of nearly the entire market of at-home ovulation test kits, including Kramer Levin client SPD Swiss Precision Diagnostics, maker of the Clearblue brand. The Second Circuit agreed with our team's arguments that no reasonable consumer can be misled to believe that the kits test for ovulation with 99% accuracy, because “there is nothing affirmatively inaccurate on the front label . . . that states the at-home tests detect for actual ovulation” and the sides and back labels “are clear that the products detect surges in the LH hormone, a strong predictor of ovulation, not ovulation itself.” The panel also agreed that the district court did not err in denying plaintiffs leave to replead, and affirmed dismissal with prejudice. On March 13, Kramer Levin teamed up with Catholic Charities of the Archdiocese of New York for a limited-scope pro bono clinic to assist refugees and recent arrivals with filing asylum applications. Asylum is a form of immigration relief that may be granted to people who have been persecuted or fear they will be persecuted on account of race, religion, nationality, political opinion and/or membership in a particular social group. After the clinic, Catholic Charities worked with the clients to file the applications. This was a wonderful collaboration between attorneys, translators, paralegals and other staff members at the firm. We would like to thank Catholic Charities for taking the time to work with our team on such a critical project.
