  • Important Tax Update for Insurance Affiliates! The Washington Supreme Court recently ruled in Envolve Pharmacy Solutions v. Department of Revenue that affiliates of insurance providers may qualify for a B&O tax exemption if the gross premiums tax has already been paid. This decision clarifies years of inconsistent guidance from the Department of Revenue and presents a significant refund opportunity for affiliates providing administrative services. It also raises a key question: Could any entity—not just affiliates—qualify if the premiums tax is paid? • Important Update on B&O Tax Deductions in Washington State The Washington Supreme Court's recent decision in Antio, LLC v. Department of Revenue restricts the B&O tax deduction for investment income, impacting businesses that generate significant investment revenue. The ruling limits deductions to investment activities that are “incidental” to the main business, posing potential tax liabilities, penalties, and interest for non-compliance. Businesses should promptly review their reporting practices and consider strategies to mitigate risk while awaiting potential legislative or judicial updates. #taxes #washingtontaxes #businessinWA

Anddd we're back! Hoping you all had a lovely holiday weekend. Let's dig in: In this week's issue of Tax Notes State,?Caleb Allen and?Patrick Murphy discuss Washington’s newly updated business and occupation tax apportionment rule. Amendments to Rule 19402 (Wash. Admin. Code section 458-20-19402), adopted in May and effective June 15, address the DOR and taxpayers’ difficulties with the state’s 2010 implementation of receipts attribution based on the benefit of the service. Noting that the main issue involved section 303(c) of the former rule, concerning attribution of receipts from business services not related to real or tangible personal property, the authors write that “the crux of the challenge is that taxpayers and the department have frequently disagreed about what the customer’s related business activities are and where they occur.” The new analytical framework in Rule 19402 provides a series of cascading hierarchical questions to more uniformly determine a customer’s related business activity, “in the hope of reducing controversy and uncertainty” for taxpayers and the DOR alike. Read on for more: <https://lnkd.in/euGE-Tms> Further insights from and thanks to: Sujata Yalamanchili, Joshua Lawrence, and Gavin Meade, for highlighting sales tax pitfalls for buyers in New York real estate transactions; Ted Peterson, for examining the future of the SALT cap as its sunset date nears, suggesting a new approach to the controversial limitation; Adam Golden, for interviewing Brian Frey, Elissa Krinsky, and Larry Van Blerkom on their career transitions from Big Four public accounting to corporate leadership roles; and Robert Willens, for discussing recent California Office of Tax Appeals decisions in McGarvey-Clark Realty and Avis Budget Group.
