Policy change at the U.S. Securities and Exchange Commission (SEC) does not bind courts from analyzing the key question of whether certain crypto transactions are covered by federal securities laws. Kobre & Kim’s?Sydney Johnson and Calvin Koo explore how private plaintiffs may take advantage in a piece for CoinDesk. Under the new administration, the SEC has confirmed the end of the regulation-by-enforcement era and taken significant steps to progress its policy goals, including a focus on prosecuting bad actors and fraud in the digital asset space. While this shift has dramatically reduced exposure to regulatory suits by the agency, the industry must prepare for private plaintiffs to exploit the enforcement void. As a result, companies should expect an increase in private litigation, and businesses and their founders re-evaluating their legal risk should confer with their legal teams on whether they may be targets of increased private litigation, so they can create strategies to mitigate such exposure. In a US $604.9 million verdict in October 2024, the Alameda County Superior Court in California ruled that Phillips 66 willfully and maliciously misappropriated trade secrets from Kobre & Kim client Propel Fuels. On March 4, 2025, Propel and Phillips 66 met again to address Propel’s request for US $1.2 billion. Kobre & Kim’s Daniel Zaheer sat down with WIPR - World IP Review to discuss the exemplary damages hearing. The case comes at a time when trade secret damages awards in the U.S. are increasingly in the spotlight. In recent years, there have been staggering amounts both awarded and reversed. Now, all eyes are on Propel and how it could potentially influence the scale of damages awarded in future trade secret disputes. “Everybody understands there's a lot of money at stake. The issues are important because this is one of the largest misappropriations that's ever been found to have occurred by any court,” Mr. Zaheer explained. “I think it's a remarkable case because of the amount, but it's not a remarkable case in terms of just applying the law. The law says that the appropriate method of punishment is up to two times what the jury awarded,” Mr. Zaheer concluded. “So we're just asking for an appropriate application of the law.” More after the jump: https://lnkd.in/e69WvH4H

As managing one’s reputation becomes increasingly difficult in the new era of AI, scammers are weaponizing AI-powered tools to manipulate public perception.?Kobre & Kim’s Polly Wilkins sat down with Tatler to share her insight on the threats posed by AI-powered scams, and what preventative measures individuals can take to protect themselves. ? Beyond proliferating false narratives, AI-powered scams create the risk of identity theft and fraud. “Some attacks go beyond financial fraud, aiming to trigger sanctions by allowing competitors, disgruntled partners, or political adversaries to weaponise disinformation,” Ms. Wilkins explained. “The goal can be to trigger red flags that lead banks or financial institutions to freeze assets or deny services—often with little chance of reversal. Once a false narrative gains traction in a national newspaper, it can draw government scrutiny. To counter such threats, clients need a well-prepared crisis protocol to dismantle these campaigns effectively.” Seeking help from experts in this space can be pivotal in preventing these threats before they occur. “Vigilant monitoring is key, and having a dedicated team tracking even seemingly minor online mentions can help detect early signs of a disinformation campaign,” Ms. Wilkins shared.
