Klarquist partner John Vandenberg shares a largely overlooked aspect of U.S. patent law: the right to copy and use designs described in expired U.S. patents. He notes that the Federal Circuit’s recent Allergan decision on obviousness double patenting, which was widely welcomed, did not address a 1945 Supreme Court Scott Paper decision broadly stating the right to use designs of expired patents. Google?at the Federal Circuit on behalf of SAS Institute and a coalition of tech leaders, advocating for stricter enforcement of gatekeeping under Rule 702 and Daubert.
