Klarquist partner John Vandenberg shares a largely overlooked aspect of U.S. patent law: the right to copy and use designs described in expired U.S. patents. He notes that the Federal Circuit’s recent Allergan decision on obviousness double patenting, which was widely welcomed, did not address a 1945 Supreme Court Scott Paper decision broadly stating the right to use designs of expired patents. Klarquist has filed an amicus brief in?EcoFactor v. Google?at the Federal Circuit on behalf of SAS Institute and a coalition of tech leaders, advocating for stricter enforcement of gatekeeping under Rule 702 and Daubert. The Court will review en banc whether the trial court properly allowed certain expert testimony on a “reasonable royalty” in this patent infringement case.?Click below to read the full brief.
