"Takeaway:?We have written before about the Illinois Biometric Information Privacy Act (BIPA) and the risk of annihilating damages in class actions if every alleged biometric scan or transmittal of that scan for a single person constituted a separate violation. After the Illinois Supreme Court ruled that each such scan could constitute a violation in 2023 (Illinois Supreme Court Clarifies BIPA Violation Accruals Opening the Door for Annihilative Damages), the Illinois legislature responded by amending the statute in 2024 (Illinois legislature passes bill amending BIPA violation accrual standards). The Northern District of Illinois recently held that this amendment constitutes a “clarification” of existing law and thus applies to actions pending at the time of its enactment.?Gregg v. John F. Pierce?and?Siegmar Pohl?of Kilpatrick recently presented a portion of “The Current State of Play of Carbon Credit Markets” hosted online by the Federal Bar Association and myLawCLE. They focused on the associated risks and liabilities of carbon credits and trading, what the future holds for regulations, impacts of cross-border trade (using CBAM and other mechanisms), and association and treaty obligations (such as Article 6 of the Paris Agreement obligations). In recent years, the path to approval for bank mergers has often been uncertain, meandering and frustrating for all parties. Often, the merging institutions have been forced to extend the drop-dead dates in the face of regulatory uncertainty and, in some cases, deals have been abandoned because the parties lacked a clear path to agency approval. This situation is likely to improve as two federal regulators — the Office of the Comptroller of the Currency (OCC) and the Federal Deposit Insurance Corp. (FDIC) — have issued final guidance that should provide greater clarity about the prospects for regulatory approval before financial institutions sign a merger agreement.
