We handle business disputes and litigation across a wide spectrum of cutting edge and evolving industries (including entertainment, IP, real estate, finance, cannabis, cryptocurrency and general business). We have a close-knit and collegial team. The ideal candidate desires significant front-line litigation and trial experience who’s ready on a day-to-day basis to drive cases on their own, interface with clients and adversaries, make decisions and appear in court. Strong academic credentials (Top 10% of class) along with Big Law or federal clerkship experience is a plus, but not a requirement. Candidates must be admitted in California. In this edition of the KF&C California Law Blog, we discuss a powerful but often underappreciated tool available to defendants sued by out-of-state plaintiffs or foreign corporations in California. Under California Code of Civil Procedure Section 1030, a defendant may request that the plaintiff submit an undertaking to secure potential costs and attorney's fees—typically in the form of a bond—if the defendant can show there is a “reasonable possibility” they will prevail at trial. When defending clients against non-resident plaintiffs, especially where attorneys' fees are at issue, practitioners should consider seeking an order for an undertaking. This tool offers a strategic advantage, with a relatively low bar to prove a “reasonable possibility” of success. When successful, it may pressure the plaintiff to dismiss their claim early on, saving significant time and expense. In a recent victory, Kibler Fowler & Cave secured an order requiring foreign corporate plaintiffs to post a $300,000 undertaking to cover potential fees and costs in Shenghua Entertainment, et al. v. Cinelou Films, LLC, et al., LASC Case No. 22STCV34604. By demonstrating that there was a reasonable possibility of success for our clients, the Court ruled in our favor—and, facing the substantial bond requirement, the plaintiffs ultimately dismissed the case in full.
