We advise our clients to do a preliminary prior-art search before considering filing a patent application. Why? Because even a quick prior-art search will save a smart inventor from developing something that’s already patented, or already in the public domain. A prior-art search also helps inform an inventor about the state of the art of an invention, which greatly informs research and development. Working with inventors over the years, I learned that they were of a type: white, male, middle- and upper-class. Few were women, and even fewer were people of color. Eighty percent, in fact, of our clients are white males. While I applaud their successes, I wonder where the rest of the population is. Income and gender don’t determine intelligence, but without access, exposure and education, an inventor may not even know where to start. On May 1, the US Patent Office launched the “National Strategy for Inclusive Innovation,” an initiative that aims to increase innovation among people from historically underrepresented and underresourced communities.
