PREVAIL Act: Seeks to limit challenges to patents at the Patent Trial and Appeal Board (PTAB) by imposing a standing requirement and barring certain invalidity arguments. The sponsors of both bills, Senators Coons and Tillis, are working on amendments to address concerns raised by other senators. Some of the concerns include the impact on generic drug competition and the fairness of the PTAB process for small inventors. However, the committee did approve the IDEA Act, which allows the patent office to collect demographic data on inventors to address inequality in the patent system. This bill aims to identify and address gaps in patent acquisition among different demographic groups. The postponement of PERA and PREVAIL represents a setback for patent owners who support these bills, while those who oppose them, including the tech and generic drug industries, see it as a positive development.

AFCP 2.0 Being Retired ?The United States Patent and Trademark Office (USPTO) is terminating the After Final Consideration Pilot Program 2.0 (AFCP 2.0) on December 14, 2024. The decision comes after a proposed fee to offset the program's costs faced public opposition. AFCP 2.0 allowed applicants to request reconsideration of their patent applications after a final rejection. However, the high usage of the program led to significant administrative costs for the USPTO. Although the program was initially set to expire on September 30, 2024, the USPTO has extended the deadline to December 14, 2024, to give applicants time to adjust. After December 14th, applicants will still have other options for after-final consideration, such as routine examination practice amendments, examiner interviews, and pre-appeal brief requests for review. https://lnkd.in/ebRfkBuC ?
