Stepping up.... This month, KBA’s Florida Office stepped in to donate to Growing Together Behavior Center (“GTBC,” Jacksonville, FL). The donation was used to pay for a new playground for the kids after the GTBC’s most recent playground was stolen in June. A Go Fund Me Page caught the firm's attention after seeing a news report. The firm saw the wide gap between the need and what they had recovered and sent Partner Robert Price out to right the wrong. See more here: https://lnkd.in/e9CW-PR4
The faces of KBA..... Created this using ChatGPT. We uploaded nine separate image files of differing types and sizes. We prompted it to combine the pictures, which was a poor prompt. A few prompts later, it produced the following. Next week we'll announce and add our newest woman partner. Love this tech and we're only just beginning.....
Shout-out to KBA Partner Whitney Butcher. After hours buried in the briefing cave and months of waiting, she got her victory. ?? **Victory for Justice: A Landmark Decision in Perez v. KIPP DC Supporting Corp. and Capital City Public Charter School** ?? The U.S. District Court for the District of Columbia just ruled in Shanique Perez v. KIPP DC Supporting Corp. and Capital City Public Charter School. This case exemplifies the power of dedicated legal advocacy in the fight for justice, particularly for survivors of sexual abuse. **The Case:** Shanique Perez, a courageous plaintiff, sought damages for the horrific sexual abuse she endured as a minor at the hands of her teacher, who was employed first by KIPP DC and later by Capital City Public Charter School. Her journey for justice began years ago, with her initial case dismissed due to statutory limitations. However, with DC's enactment of the Sexual Abuse Statute of Limitations Amendment Act of 2018, she had hope and turned to KBA. **The Legal Battle:** The Court’s recent order meticulously addresses multiple motions: - **Defendants’ Motions to Dismiss:** Both KIPP DC and Capital City sought dismissal of Perez’s claims, arguing procedural and substantive grounds. The Court denied significant portions of these motions, allowing key claims to proceed. - **Motion for Leave to Amend:** Perez’s motion to amend her complaint was largely granted, enabling her to fortify her allegations with additional factual details, crucial for her claims of gross negligence and intentional infliction of emotional distress. **Legal Issues and Skills:** This victory highlights several critical legal issues and the skills employed: - **Application of New Statutes:** The case underscores the importance of understanding and applying newly enacted statutes to revive previously time-barred claims, showcasing legal ingenuity and perseverance. - **Constitutional Challenges:** The Defendants raised substantial constitutional arguments, which Whitney navigated deftly. - **Detailed Factual Allegations:** The success of Perez’s motion to amend her complaint illustrates the necessity of detailed factual allegations in overcoming procedural hurdles and advancing substantive claims. **What’s Next:** The case is set to proceed with a revised schedule for discovery and dispositive motions. We prepare for trial with the resilience and courage of Ms. Perez. **Why This Matters:** This victory is a testament to how diligent, compassionate, and skilled legal representation can change lives. It exemplifies the profound impact of legal reforms in providing avenues for justice that were previously closed. Most importantly, it serves as a powerful reminder that survivors of sexual abuse have the right to seek redress and that the legal system, when navigated by dedicated professionals, can uphold justice. #LegalVictory #JusticeForSurvivors #CourtRuling #LegalReform #Advocacy #PerezVsKIPPDC #JusticePrevails #SexualAbuseSurvivors
KBA superstar, Whitney Butcher, ready to serve in D. Md! Ms. Butcher is litigating an important institutional sex abuse case in federal court in Baltimore now. She is building upon her prior experience with the BHR artificial hips mass tort MDL there. Much more to come as her catastrophic injury practice in North Carolina (trucking collisions, nursing home, med mals, etc.) and mass tort practice continues to thrive.
Newest U.S. District of Maryland minted lawyer right here ?? Thanks to my good friend and law partner Justin B. for sponsoring my admission. We met in a buffet line 10 years ago discussing Granuflo, my very first mass tort case. I’m so proud to work together now at KBA Attorneys - Law Firm #Marylandpersonalinjurylawyer #personalinjuryattorney #medicaldevicelawyers #nursinghomelawyers
Great time with the KBA team at Maryland Association for Justice, Inc. this weekend to honor Maryland Trial Lawyers of the year, KBA’s own, Reza Davani and Tara Eberly from JJS. Nice to have the nursing home team that has secured 9M and 1.6M jury verdicts for clients within the last year at the event to celebrate with him.
Awesome to have our partner Whitney up for the MAJ event. Excited to have Whitney working with Reza Davani on nursing home cases in North Carolina and trucking collision cases there as well. Whitney has done great work for our mass tort (failed toes like Cartiva, failed and defective hernia mesh, and other medical devices including knees, elbows, and shoulders) and our institutional sex abuse survivors. We’re confident we’ll have great results to report soon!
My partner at KBA Attorneys - Law Firm, Reza Davani, got a historic $9 million nursing home verdict in Maryland and was named trial lawyer of the year by the Maryland Association of Justice. His dogged determination and fresh perspective on trial work are incredible and this was a well deserved honor. It was wonderful to celebrate Reza and our firm at the awards dinner, and spend some time with Justin B. and Brian Ketterer and other awesome members of our firm.
