The U.S. Court of Appeals for the D.C. Circuit has ruled in Marin Audubon Society v. FAA that the Council on Environmental Quality (CEQ) regulations, which guide federal agencies in NEPA compliance, are “ultra vires” and thus invalid. This landmark decision raises significant questions for ongoing and future NEPA reviews, as agencies can no longer rely on CEQ guidelines to meet compliance standards. ?
