?? #BOI Legislation Passes House ?? While the Samantha Smith case is making its way through the court system, the House of Representatives has taken action. On Monday evening (Feb 10), the House of Representatives passed H.R. 736, the Protect Small Businesses from Excessive Paperwork Act of 2025. The bill was introduced by Rep. Zach Nunn from Iowa, and it would delay FinCEN BOI reporting for one year, until January 1, 2026.?The bill unanimously passed the House of Representatives?by a vote of 408-0.??The bill now goes to the Senate for consideration. Yesterday, a companion bill, S. 505, was introduced by Senator Tim Scott. These bills support the AICPA's long standing position for a significant delay to help small businesses. While this is hopeful information, the Samantha Smith case injunction can be lifted at any moment which would allow Financial Crimes Enforcement Network, US Treasury to enforce the BOI reporting - though FinCEN has stated they will issue a 30 day extension to file. Additionally, both bills are applicable to companies pre-existing to Jan 1, 2024. Under the bills, all companies formed after Jan 1, 2024 would have BOI reporting due as originally outlined by the Corporate Transparency Act. Follow AICPA and me for the latest updates on BOI.
