  • On January 21, 2025, the U.S. District Court of Maryland issued a Preliminary Injunction temporarily halting key provisions of Executive Orders 14151 and 14173, which aimed to restrict Diversity, Equity, and Inclusion (DEI) initiatives. The court found certain certification and enforcement requirements likely "unconstitutionally vague." While this ruling is not final and may be appealed, Executive Order 11246 remains revoked. Employers should continue to comply with Title VII and other federal anti-discrimination laws. Kairos is monitoring developments and will provide updates as they emerge.   • ?? Preliminary Injunctions Against DEI Executive Orders ?? The challengers showed they are likely to prove the contract termination and enforcement threat provisions of the Executive Orders are “unconstitutionally vague on their face,” Judge Abelson wrote. Judge Abelson clarified that the Executive Orders don’t define terms such as “DEI” or “equity-related,” nor do they identify what programs or policies would be considered “illegal”. Kairos is continuing to review this development and will provide guidance in the coming days.

  • ?? DEIA & Compliance: What Employers Need to Know With Executive Order 14173 bringing increased scrutiny to DEIA initiatives, many organizations are reassessing their approach. While Diversity, Equity, Inclusion, and Accessibility (DEIA) is not inherently unlawful, how it’s implemented can have risk implications - especially when any part of the employment decision making process explicitly or implicitly considers protected characteristics. Employers can maintain legally sound DEIA initiatives by ensuring: ? Clear definitions and communication of DEIA principles ? Alignment of policies with Title VII and EEO laws ?
