Congratulations to Stephen Stern and Shannon Hayden for helping a client prevail on the primary claim in a six day federal jury trial earlier this year, then later succeeding on a motion for new trial when the court, in a 42 page opinion, found it had erred by allowing the plaintiff to amend its complaint after the close of all the evidence to include a new claim on which the jury had ruled in the plaintiff's favor. Earlier this summer, a federal court in Texas issued a preliminary injunction that prevented the FTC from enforcing or implementing its new rule banning most non-compete agreements. That same court has now set aside the FTC rule, finding it exceeds the FTC's rulemaking authority and it was arbitrary and capricious. https://lnkd.in/eR5FSFHU

The United States Court of Appeals for the Ninth Circuit recently issued an important decision that concerns class action litigants and, in doing so, it addressed an issue of first impression, that being "when does the narrowing of a class definition end . . . the tolling of the statute of limitations for members of a putative or certified plaintiff class?" The court ultimately concluded that tolling of the statute of limitations ends when the narrower class definition becomes "unambiguous."
