    What a great day supporting the YWCA Hanover at their Annual Walk A Mile fundraiser! Due to weather - we had to PIVOT (Janise Bankard!) and make it work with the mud and muggy heat! This is the 2nd year my family and I volunteered and I look forward to many more! Sorry Allie Harris the weather was too bad for you to come! Great job team!! I look forward to seeing the end total we raised for Safe Home and their domestic violence services!

    Environmental Due Diligence Specialist

    I have seen this too often in the last couple weeks to not call it out as a concerning practice! If you receive a Phase I ESA that recommends a file review in the Phase 2 - that means you received a non-ASTM compliant Phase I ESA! See Section 8.2.3 of the standard quoted at the bottom of this post. Here are some tips/thoughts on this: - If the contract/proposal you signed stated you would receive an ASTM 1527-21 compliant Phase I ESA, you have every right to push back and ask for a revised Phase I with no cost to you/your client which includes a file review! - If you requested a RUSH report and the environmental professional (EP) stated there are files with the state agency and they can't be reviewed within that timeframe, and you said you want the report prior to the review, that is your fault. However, this lack of file review needs to be listed as a significant data gap and the EP can opine on its potential to affect the outcome of the report. - If the EP's Phase I contract states that the file review will be an extra charge, look for a new EP. (There are exceptions to this such as large brownfields projects but that is known going into the proposal.) - Paper records held at the regional state agency ARE reasonably ascertainable even if we all prefer electronic copies. - Simply relying on the "Closed" status of a record in the ERIS/EDR database report to remove it as a concern is not enough. (See quoted section of standard below.) I have seen too many instances when the "closed" site has additional requirements, missed areas of concerns, new standards or parameters of concern, only a partial closure, post remediation care activities and/or a covenant/deed restriction requirement that hasn't been followed through on. Section 8.2.3: "If the subject property or any of the adjoining properties is identified on one or more of the standard government environmental record resources in 8.2.2, pertinent regulatory files and/or records associated with the listing should be reviewed in accordance with 8.1.1 through 8.1.8. The purpose of the regulatory file review is to obtain sufficient information to assist the environmental professional in determining if a recognized environmental condition, historical recognized environmental condition, controlled recognized environmental condition, or a de minimis condition exists at the subject property in connection with the listing. If, in the environmental professional’s opinion, such a review is not warranted, the environmental professional must explain within the report the justification for not conducting the regulatory file review."

    Second clip of my conversation with Martin Siegel of Barley Snyder about the recent PFAS CERLCA designation and environmental due diligence! ?? ?? Enter into transactions with eyes wide open and consult your professionals early because it's a long process if the PADEP needs to be involved. Joint and Several Liability- what the heck is that? -Joint and several liability?makes all parties in a suit responsible for damages up to the entire amount awarded. That is, if one party is unable to pay, the others named must pay more than their share. All was good... is it still good? - This conversation talks a bit more about the current owner who already had closures or due diligence prior to PFAS designation! An owner may fall under the liability protections because they "didn't know and had no reason to know" about PFAS presence during their purchase. However, it will take some legal wrangling and hoops to get out of it and that won't be cheap either! - Buyers- what is your risk tolerance and what are your future plans? Have that conversation with your legal and environmental team. This doesn't change now that PFAS has been added, this should have always been the case. As you can see, I am not a professional video editor! And why was I blinking so much ??? Now I'm hyper focused on my blinking and I think it was an "I am being recorded tick" ?? Future clips of this conversation will include red flags ?? (you know how much I love to talk about red flags), buyer/seller agreement ??, and some other nuggets of info! What we won't be talking about is how to remediate, how the standards were established, how to sample... those are much larger questions that require a different type of expert to be interviewed!

    Juniper Environmental has formed a team to participate in the Walk a Mile fundraiser for the Hanover YWCA. I would love to have you join my team and walk us, with or without the heels/boots. This fundraiser is a critical funding source for the domestic violence and human trafficking services provided by the YWCA Safe Home. By wearing women’s shoes, participating gentlemen symbolically put themselves in the place of women for the purpose of raising awareness about the dire effects of sexual and domestic assault in our community. Funds raised will help to provide services for survivors of domestic violence. Women are also welcome to register and walk as supporters!
