?? Title IX Update! On Wednesday, the Eleventh Circuit Court of Appeals granted a temporary injunction halting enforcement of the Biden administration's recent Title IX regulations while the court takes a closer look at the issues presented by the parties. The lawsuit alleges, in part, that the Biden administration went beyond its authority by extending Title IX regulations to apply to discrimination based on gender identity. The regulations were set to take effect yesterday, August 1, 2024. This is the first major step by the court in a suit filed by the states of Alabama, Florida, Georgia, and South Carolina, joined by several other parties, seeking to permanently enjoin enforcement of the new regulations. While it is unclear whether the court intended to block the rule nationwide or only for these four states, the Department of Education interprets the order to only block implementation and enforcement in the four states that appealed, and continues to seek review from the U.S. Supreme Court after the Fifth and Sixth Circuits denied its request to continue to enforce uncontested portions of the new rule. The court ordered a tight briefing schedule.
