Our practice areas include Divorce, Post-Divorce, Alimony, Prenuptial and Postnuptial Agreements, Child Custody, Child Support, Adoption, and more.     In Tennessee, property division during a divorce follows the principle of "equitable distribution." This means that the division of marital property is done in a manner that is fair, but not necessarily equal. There are 3 key steps and considerations in the property division process in Tennessee: Identification of marital property, valuation of marital property and division of marital property. If both spouses can agree on the division of property, they can present their agreement to the court for approval. If the court finds the agreement to be fair and equitable, it will typically be approved without further modification. In cases where spouses cannot reach an agreement, the court will make the final decision on how to divide the marital property.   • In Tennessee, there are several grounds for divorce, which can be categorized into two types: no-fault and fault-based grounds. Here are the grounds for divorce in Tennessee: ? ????-?????????? ??????????????: → Irreconcilable Differences: This is the most common ground for divorce in Tennessee, where both parties agree that their marriage is irreparably broken. ? ??????????-?????????? ??????????????: → Adultery: One spouse has been unfaithful. → Willful Desertion: Abandonment by one spouse for at least one year. → Conviction of an Infamous Crime: One spouse is convicted of a crime that results in imprisonment. → Conviction of a Felony: One spouse is convicted of a felony and is sentenced to serve time in prison. → Habitual Drunkenness or Drug Abuse: Ongoing substance abuse that began after the marriage. → Cruel and Inhuman Treatment: This includes physical abuse, emotional abuse, or any behavior that makes living together unsafe or intolerable. → Inappropriate Marital Conduct: Any behavior by one spouse that makes the marriage intolerable for the other spouse. → Impotence: Inability to engage in sexual intercourse that was not disclosed before the marriage. → Bigamy: One spouse was already married to someone else at the time of the marriage. → Pregnancy of the Wife by Another Man: If the wife was pregnant by another man at the time of the marriage and the husband was unaware. → Refusal to Move to Tennessee: Willful refusal by one spouse to move to Tennessee with the other spouse without a reasonable cause. → Malicious Attempt on the Life of the Other: One spouse attempts to take the life of the other. #TennesseeDivorce #NashvilleLawyers #JerniganLaw
