On March 4, 2025, the U.S. Supreme Court issued a landmark decision in City and County of San Francisco v. Environmental Protection Agency, significantly restricting the EPA's permitting authority under the Clean Water Act (CWA). The Court ruled that the EPA cannot impose "end-result" requirements in NPDES permits, which condition compliance on meeting water quality standards. This decision provides greater clarity and predictability for permit holders, reinforcing the CWA's "permit shield" provision and ensuring that compliance with specific permit terms protects against liability. In a swift policy reversal, the U.S. announced that goods eligible under the 2020 United States-Mexico-Canada Agreement (USMCA) can enter the country duty-free until April 2, 2025. This change comes just 48 hours after imposing 25% tariffs on imports from Mexico and most imports from Canada. Notably, potash imports not covered by the USMCA will now face a 10% duty rate instead of 25%. Additionally, the U.S. has imposed a further 10% tariff on all imports from China, effective March 6, 2025, bringing the total tariff to 20%. Businesses should stay alert as more changes are expected, including a 25% tariff on steel and aluminum starting March 12, 2025, and potential tariffs on foreign agricultural products and cars by April 2, 2025. Starting March 4, 2025, the U.S. Customs and Border Protection (CBP) will impose a 25% duty on most products imported from Mexico and Canada. Here’s what you need to know: ·?Applies Despite USMCA: The tariffs are assessed regardless of the current USMCA agreement. ·?Foreign Trade Zones: The 25% duty also applies to goods in U.S. Foreign Trade Zones. ·?Additional Tariffs: Separate from other tariffs, such as those on steel and aluminum starting March 12th. ·?No Duty Drawback: Not eligible for duty drawback. ·?No Exclusion Process: There is no exclusion process for these tariffs.
