New (as of 3/25) Executive Order on Elections includes a factually inaccurate sentence around lobbying for nonprofits who receive federal funding. The law does not prohibit nonprofits from lobbying, but limits nonprofits and businesses from using federal funds to influence federal funding decisions. Other revenue sources can be used to lobby (within the existing limitations that guide tax-exempt organizations). The EO does not change this law, and will most likely be challenged in court. Just as the current threats to the nonprofit sector are new in their scope and severity, we in the nonprofit field must work together in new and expanded ways. Build and bolster partnerships. Tell the story of all the good nonprofits do in new, more highly visible ways, expand public support. Litigate, advocate, communicate, agitate. Put simply, there isn’t a way for the nonprofit sector to end 2025 in a neutral place. We’ll either end the year on a spectrum of harm – from somewhat harmed to potentially decimated. OR, we’ll end it strengthened - not just in spite of, but *because of* the threats. If we do this right, we’ll be strengthened: - through new partnerships and collaborations, expanded coalitions - with sophisticated legal and other “new to us” strategies - through robust and clear communications to shore up support for nonprofits - and by effectively making our case to members of Congress and the public Above all, we’ll be strengthened through solidarity, by uniting to defend and advance the entire sector, together. Onward.

Our team at the Building Movement Project just updated the Nonprofits in the New Landscape FAQ. In this resource, we focus on how nonprofits could be affected by the current landscape, with an emphasis on those who serve vulnerable communities that are being targeted by many federal actions. The latest update to the FAQ notes the March 7 Executive Order on public service loan forgiveness, which proposes changes to the program that may exclude workers who are employees of nonprofits engaging in “illegal activities” from receiving debt forgiveness for student loans.
