Two Texas death row cases made headlines last week–Melissa Lucio and #RobertRoberson. These cases remind us that miscarriages of justice regularly occur in capital cases and also that revelations of innocence are often not enough to stop executions.

Two strikingly similar cases in Texas involving decades-old claims of "shaken baby syndrome" are making news this week. In one, a Dallas County man, Andrew Roark, has been exonerated. In the other, #RobertRoberson is waiting on an execution date.

The Texas Supreme Court has cleared the way for #RobertRoberson's execution to be rescheduled. His attorney, Gretchen Sween, is hoping it won't be. "This is entirely on the shoulders of the local district attorney in Anderson County," said Gretchen.

Melissa Lucio was two days away from being put to death in Texas for the murder of her 2-year-old daughter when an appeals court intervened in 2022. Now, a judge agrees Melissa never committed the crime at all.

With limited options remaining, #RobertRoberson's legal team is urging the state to delay scheduling a new execution date, expressing hope to prove his innocence.
