Children born via surrogacy in the U.S. are U.S. citizens. Italy’s strict surrogacy laws are raising concerns. The U.S. fears these children may face discrimination when returning to Italy with their parents. They could even risk separation from them. The parents are fully recognized under U.S. law on birth certificates and legal documents, as the legal parents of these children. A State Department spokesperson told La Repubblica: “The United States will continue to promote a world free from discrimination, so that members of every family and all people, including LGBTQI+, can live with dignity and respect for their human rights.” These comments mark a rare tension between Prime Minister Meloni’s government and President Biden, despite otherwise warm relations.

Over 50 Italian couples have engaged the Luca Coscioni Association to challenge Italy's recent surrogacy law. This legislation not only bans surrogacy within Italy but also prohibits residents from seeking surrogacy services abroad. The Association's leaders, Marco Cappato and Filomena Gallo, stated: "We are ready to defend all couples damaged by this unjust and unreasonable law. We will take our and their battle to the courts and to every appropriate venue, with the aim of re-establishing an opportunity offered by science, which a blind and brutal law claims to condemn as a universal crime." Critics argue that this law disproportionately affects same-sex couples, effectively hindering their ability to start families. The legislation has been described as an "inhumane act against parents and children, which only fuels stigma and discrimination." Politico Europe The Luca Coscioni Association is committed to advocating for the rights of all couples, emphasizing that surrogacy, when conducted ethically, is a legitimate means of family building.

Last month, authorities in Cambodia discovered 24 foreign women living on a property in Colombia. Among them, 13 pregnant Filipinas were detained and now face potential charges for allegedly conspiring to sell their babies. They could face prison sentences of 2–5 years. The Cambodian prosecutor has stated that the women will not be treated as victims but as offenders. Meanwhile, the Philippine Embassy ensured the presence of representatives and interpreters during every stage of the investigation. Details remain unclear about the surrogacy agency involved, and officials have yet to identify the organizers behind the scheme. This case underscores the complex and often troubling realities of surrogacy in regions where regulation is lacking.

In late October 2024, Philippine authorities, arrested Freezle Rose Balondo, a surrogate coordinator for MLE & Mlang International Surrogacy, LLC—a California-based company. Balondo was apprehended at Ninoy Aquino International Airport while attempting to escort two Filipino women on a purported "tour in Bangkok." Inconsistencies in their statements led to further questioning, during which the women revealed they had been recruited by Balondo to serve as surrogates in Cambodia or Thailand. Balondo had allegedly provided them with falsified employment and travel documents. She now faces charges under the Anti-Trafficking in Persons Law.
