Our founder and Principal Attorney, Bruna Frota, is well versed in business immigration and has experience in U.S. immigration with large multinational corporations and regional companies in the oil & gas, pharmaceutical, technology, medical, and engineering industries. Her experience encompasses assessing clients’ U.S. migration needs, developing and facilitating short and long-term migration strategies. DHS Announces Temporary Immigration Protections for Lebanese Nationals in the U.S. The U.S. Department of Homeland Security (DHS) has announced new measures to offer temporary immigration relief to eligible Lebanese nationals currently residing in the United States. The actions include details on Deferred Enforced Departure (DED) for Lebanese nationals, as previously announced in July, and a planned new Temporary Protected Status (TPS) designation for Lebanon. After consulting with interagency partners, Secretary Alejandro Mayorkas announced an 18-month TPS designation for Lebanon due to ongoing armed conflict and extraordinary temporary conditions that prevent Lebanese nationals from safely returning home. Those approved for TPS will be allowed to remain in the country while the United States engages in diplomatic efforts to achieve lasting stability and security along the Israel-Lebanon border. The TPS designation permits Lebanese nationals (and individuals without nationality who last habitually resided in Lebanon) who have continuously resided in the United States since October 16, 2024, to file initial applications for TPS, provided they meet eligibility criteria. Lebanese nationals who entered the U.S. after this date will not be eligible. Further details on TPS applications and employment authorization will be outlined in an upcoming Federal Register Notice, which DHS intends to publish in the coming weeks. Individuals are advised not to apply for TPS under this designation until the notice is officially published. In addition, U.S. Citizenship and Immigration Services (USCIS) has issued a Federal Register Notice outlining procedures for Lebanese nationals covered by President Biden’s July 26, 2024, grant of DED to apply for Employment Authorization Documents (EADs) valid through January 25, 2026. Eligible individuals can apply for an EAD by submitting Form I-765, Application for Employment Authorization. Each application will be assessed individually to determine eligibility. More information on DED-based EADs is available on the USCIS website. DHS is also releasing a Special Student Relief Notice for F-1 nonimmigrant students who are Lebanese citizens or individuals without nationality who last habitually resided in Lebanon. Eligible students may request employment authorization, work increased hours while school is in session, and reduce their course load while maintaining F-1 status throughout the DED designation period. Approximately 11,000 Lebanese nationals are expected to be eligible for DED and TPS under these actions. Additionally, about 1,740 F-1 nonimmigrant students from Lebanon in the United States may qualify for Special Student Relief.
