As mentioned in Tuesday’s post, Neisendorf v. Abbey Paving & Sealcoating, Co., Inc., 2024 IL App (2d) 230209, contained a recent ruling affirming the trial’s court’s finding that the contract language at issue was insufficient to impose the requisite contractual control to establish a duty of care on that general contractor under Section 414 of the Restatement. In affirming the trial court’s decision, the appellate court relied on the 2003 case of Shaughnessy v. Skender Const. Co., 342 Ill. App. 3d 730 (1st Dist. 2003), noting that the trial court affirmed summary judgment for the general contractor in Shaughnessy where the general contract’s language “establish[ed] only that [the general contractor] and [the subcontractor] reserved a general right to stop, start and inspect the progress of the work.” Id. at ? 80. In the matter of Neisendorf v. Abbey Paving & Sealcoating, Co., Inc., 2024 IL App (2d) 230209 the Illinois’ Second District Appellate Court reinforced the fact that contract language granting a general contractor the general right to stop work—particularly where it does not give the general contractor control over the operative details of the subcontractor’s work—is insufficient to impose the requisite contractual control to establish a duty of care on that general contractor under Section 414 of the Restatement. As you work through issues of liability, keep a close eye on the specific contract language at issue as it may be insufficient to establish liability under Section 414 of the Restatement. #IDClaw #construction #IDCtiptuesday
