ICMA has received a number of messages asking about the James Freed lawsuit against ICMA. As our members know from their own experiences facing lawsuits from disgruntled residents, sound legal advice discourages commenting on the case. However, remaining as open and transparent as possible is important?– particularly if a party (or non-party) in the lawsuit chooses to spread misinformation and disinformation on the matter, as is the case here. ? At the end of the day, an ethics complaint was filed against a member of ICMA. The matter was researched and studied through a rigorous, and well-developed process. The Executive Board reviewed the relevant details, invited the individual to present their perspective in-person, thoughtfully debated and deliberated the matter, and reached a conclusion that there was indeed an ethics violation.? ? The decision-making process was thorough, thoughtful, and professional.?The individual disagreed with?the judgement concluded by the majority of the Executive Board, and so they filed a lawsuit. ? For the past 100 years, adherence to the ICMA Code of Ethics has remained the foundation for ICMA membership, and it binds ICMA members together around core ethical beliefs and obligations. Subjecting our conduct to the review of fellow ICMA members through a clear process is essential to maintaining public confidence. ? We are always disheartened when ethics violations rise to the level of censure. But as leaders, ICMA members are committed to engaging with these issues…thoroughly, thoughtfully, and professionally.?
