The case is about the reversal and increase of the burden of proof in transfer pricing disputes. On 22 March 2024, the Dutch Supreme Court ruled - again - on the deductibility of interest on internal loans. It confirms the Court of Appeal’s rejection of a benchmark study for an uncommercial loan and applies the abuse of law doctrine to (partly) restrict the deductibility of interest on internal loans.
