The DEI executive order is back, and so is the uncertainty. A federal appeals court has reinstated the Trump Administration’s executive order targeting private-sector DEI practices, leaving employers, especially federal contractors, facing renewed compliance pressure. What’s “illegal” under the order is still undefined, but enforcement is moving forward. Employers may now be asked to certify that their DEI programs comply with anti-discrimination laws, even mid-contract.
