The Department of Labor experienced a major win when a federal appeals court ruled that the agency has the power to set a salary base in order for workers to be considered exempt from overtime pay. A judge panel agreed with the agency and upheld the salary base only months before new rule takes effect on January 1 to raise the minimum salary level to approximately $59K. There is question on whether the agency had the authority to set any base at all and the battle is on going about whether this increase is proper. Congress gave the DOL explicit authority to define the terms of overtime exemption. Therefore, the agency was not acting outside of its bounds by setting the base salary. The agency has "consistently issued minimum salary rules for over 80 years, and its authority to do so has not been questioned by Congress." There is still a long journey ahead before the January 1 salary base will take effect. There are other challenges attacking the pending salary bump and at least one court has already ruled the DOL does not have the power to raise the base salary.
