In California, child custody decisions in move-away cases are guided by the LaMusga Factors, which assess the child’s best interests by evaluating various elements, including the distance of the move, parental cooperation, and the child’s relationship with each parent. A child’s preference may be considered if they are deemed mature enough, but it is not prioritized over other factors and is weighed collectively with all relevant considerations. Ultimately, while a child's wishes can influence custody outcomes, the court's primary focus remains on ensuring the decision serves the child's overall well-being. Since joining us in 2021, Joy has not only demonstrated an impressive legal skill set—earning her promotion to Senior Associate—but has also brought a compassionate and client-centered approach to family law and has been recognized on the Super Lawyers Rising Stars list. When a paying spouse in California retires, they may request a modification or end to spousal support, as retirement often leads to a significant drop in income. California law doesn’t set a specific age for support to end, but courts allow modifications when retirement results in lower earnings, assessing factors like both parties’ incomes, assets, age, and health. In California, spousal support obligations may change if the recipient spouse remarries or cohabitates with a new partner. Remarriage generally ends spousal support, while cohabitation can prompt a review of the recipient’s financial need, potentially leading to reduced or terminated support. The payor must show that cohabitation reduces the recipient’s need for support due to shared living expenses or financial interdependence. Understanding these rules can help make a stronger case for modifying or ending support in appropriate situations.
