Having worked with numerous state agencies overseeing licensing, compliance, and enforcement for THC hemp beverages, I find one issue unnecessarily perplexing—though it really shouldn’t be. The Child-Resistant Packaging Debate for THC Hemp Beverages. Is a standard metal can with pull tab tool child resistant? The D3475-20 standard, an internationally recognized benchmark, classifies all-metal cans with attached pull tabs as sufficiently child-resistant. States like Florida have adopted this standard, applying the same logic used for beer and alcohol packaging. However, confusion arises because federal child-resistant packaging (CRP) regulations, codified under the Poison Prevention Packaging Act (PPPA) and 16 CFR Part 1700, were established before the 2018 Farm Bill legalized cannabinoids derived from industrial hemp. This outdated framework has led to a fragmented regulatory landscape, with states imposing their own interpretations without clear federal guidance. Virginia's Regulatory Overreach In Virginia, the Department of Agriculture and Consumer Services (VDACS) has begun enforcement of child-resistant packaging requirements for hemp-derived products. Notably, § 3.2-5145.4:1(A) of the Code of Virginia mandates that any industrial hemp extract containing tetrahydrocannabinol (THC) must be in child-resistant packaging, as defined in § 4.1-600. This definition requires packaging that is difficult for children under five to open but not for normal adults. Despite this, VDACS has reportedly imposed additional, unwritten requirements, such as mandating expensive plastic tops on beverage cans, which are not specified in the statute. This approach diverges from other states with similar laws that accept standard metal cans with pull tabs as compliant. Violation of the Administrative Process Act VDACS's actions may contravene the Virginia Administrative Process Act (APA), codified in § 2.2-4000 et seq. of the Code of Virginia. The APA requires that: Regulatory actions have clear statutory authority: Agencies cannot impose new obligations absent in the law. Public notice and rulemaking procedures are followed: New standards must undergo a transparent process, including public commentary. Economic impact is considered: Arbitrary mandates can impose undue financial burdens on businesses. By enforcing unwritten packaging requirements and levying substantial fines—up to $10,000 per violation, VDACS may be overstepping its regulatory authority and bypassing the procedural safeguards intended to prevent such overreach. Call for Standardization With THC beverages emerging as a rapidly growing segment of cannabinoid products nationwide, there is a pressing need for uniform, reasonable standards for child-resistant packaging. The current patchwork of regulations fosters inconsistency, compliance challenges, and unnecessary economic strain on businesses.
