We had another appellate victory today for one of our #oilandgas clients, Ovintiv, this time in the Fifth Circuit Court of Appeals. The Court unanimously affirmed our district court win in the Western District of Texas on a royalty recoupment issue. These wins for our clients are always a team effort, and both Samantha Thompson and Jennifer Josephson were critical to our success.

I had a great time arguing at the Eight Circuit today on behalf of Grayson Mill/Devon on an #oilandgas lease dispute (splitting the argument with William Moss, who did a great job representing the other appellee). We won the case in North Dakota and I'm hoping we'll get a similar result here on appeal. Fortunately, I had great help on this case from Cody Rutowski on the briefing, one of our firm's best and brightest. Also, it's really cold here! Definitely missing Texas right now!

I'm thrilled to say that tomorrow is the five-year anniversary of the founding of Hogan Thompson Schuelke LLP. Five years ago, Samantha and I left our jobs to open up a two-person firm focusing on #energy #litigation. Our first "offices" were our dining room tables. Our first firm dinner was at Chili's in Carlsbad, New Mexico, while on a trip to visit a client site (our second firm dinner was at the same Chili's the next day...) And, of course, within two months of starting the firm, the world turned upside down with the COVID lockdowns and negative oil prices. But here we are! Five years later, we have eleven top-notch lawyers at our firm and an amazing staff too. I cannot wait to see what the firm will look like in five years!

Hogan Thompson Schuelke LLP recently represented Long Point Energy in a dispute regarding a valuable set of properties in the Utica Shale in Ohio. The firm was hired after the district court entered summary judgment on all of Long Point’s claims. Reexamining the deeds at issue and the relevant caselaw, managing partner Christopher Hogan briefed and argued the case to the Sixth Circuit Court of Appeals, which then reversed the district court. The Sixth Circuit held as a matter of law that the deed at issue in the case should be construed as requested by Long Point. #oilandgas #litigation

Another great #oilandgas #litigation win for Hogan Thompson Schuelke LLP to start the year, this time for our great client Apache (well, really their Callon subsidiary). The El Paso Court of Appeals gave us a total win on a fight over who owns some valuable #ORRI interests in the Delaware Basin. Samantha Thompson and Cody Rutowski did great work on this appeal.

Hogan Thompson Schuelke LLP had a great result today for our amazing client Ovintiv. The Northern District of Texas granted our motion to dismiss on a claim for underpayment of royalties. Texas #royalties law (and all the "fun" related to Heritage) is one of my favorite areas of #oilandgas law, and it is great when a judge digs into the law like Judge Hendrix did here.
