HJT has been training people in government, business, NGOs and local authorities since 2003, when it was first set up by barristers David Jones and Mark Symes. We now offer specialist training around human rights and business issues, as well as specific areas of law, including immigration and employment law. At the outset, we have aimed to make legal expertise accessible to those who need it and to ensure that people’s individual rights and interests are protected. Accessibility is still core to our values – to give people an understanding of how best to apply key human rights-related principles in their daily work – whether it is related to corporate responsibility, immigration concerns, or employment law. Two things mark out HJT. Firstly, we offer legal training and resources which are designed to ensure that practitioners have a foundation in every dimension of immigration law, not just in theory but taught to a standard that gets them through the accreditation exams. Secondly, we offer these resources to non-lawyers – be they civil servants, local government officials, human resources professionals – that really delivers professional insight and expertise that will help them in their daily work. HJT Training are responsible for supplying the OISC assessment papers across all 3 levels, the marking and moderation process, and the communication of exam results with examinees. We are working hard with the OISC to ensure that together we raise the standard of legal representation in the OISC sector and hope that the accreditation scheme will help us to achieve this whilst ensuring fairness, consistency and accessibility for all. We’re just a few weeks away from the 21st HJT immigration judicial review conference taking place all day in the City of London on Friday 6th December. The event is now a fixture in many immigration practitioners’ calendar, whether they are looking to push the envelope of public law or simply using JR as part of their remedies toolbox. We’ll be enjoying social networking drinks from 4pm … and its not only the drinks which can only be enjoyed "in person". We're focussing on camaraderie by not offering a live remote option. 2024 has been another busy year in immigration public law. We’ve learned that its hard to refuse a JR once departure from fundamental common law standards of fairness is established, though in national security cases it may be unnecessary to notify the subject of a citizenship deprivation case of the intention to take action against them. We’ve seen procedural legitimate expectations for the Windrush generation demand an independent reviewer and greater powers for the independent immigration inspector. The care sector’s desperation for migrant workers is clashing with the government crackdown on non-compliant sponsors, leading to a series of conflicting decisions on the extent to which the impact of putting a care home out of business on residents and the broader sector is relevant to sponsor licence revocation. And we’ve seen developments regarding the depth and intensity of JR and the degree of respect given to government. This varies: the Immigration Rules’ failure to provide a clear immigration route for refugee childrens’ relatives abroad may be challenged and an absence of evidence to back up UKVI inaction may blow wind into a JR's sails; though judges will steer clear of macro-policy issues, as seen in the challenge to the structure of the Ukraine migration routes. But government practice which thwarts the purpose of statutory protections, as where individuals have s3C leave but cannot prove it to employers and others, may be found irrational. Judges will always aim to uphold law’s empire. Thus we’ve seen a failure to review electronic monitoring as per published policy render decision making not in accordance with the law; and we’ve seen the clandestine operation of a policy contrary to how the court has interpreted it struck down as contrary to the rule of law. Fordham J continues his encyclopaedic review of public law principles hearing by hearing, giving us the most detailed thinking yet on the nature of age assessment JRs.
