Thank you, Sue Peschin of the Alliance for Aging Research, for raising awareness about this critical issue. Ultimately, it is Medicare beneficiaries navigating early Alzheimer’s who will bear the brunt of the consequences, as new treatments to delay disease progression remain out of reach due to Medicare’s Coverage with Evidence Development (CED) policy. It is imperative that members of Congress closely scrutinize CMS’s misuse of CED and oppose any efforts to expand or codify this problematic framework. This scrutiny is particularly urgent in light of the recent Supreme Court decision in Loper Bright Enterprises v. Raimondo, which removed the deference previously granted to CMS in its interpretation of Medicare law. This shift has sparked a coordinated push by others to solidify a system that not only fails to serve patients effectively but actively harms vulnerable Medicare beneficiaries. Furthermore, payers and cost-effectiveness regulators worldwide are increasingly encroaching on the authority of biomedical agencies, compromising patient access in the process. This trend must be reversed. If we fail to act decisively today, we will face an even greater societal cost in the future.
