At Hart & Hickman, our Wetlands Team is closely monitoring potential changes under the new administration while continuing to operate under the Waters of the United States (WOTUS) rule that was amended in September 2023 to conform with the U.S. Supreme Court’s decision in Sackett v. EPA. While it can be challenging to evaluate site development constraints pertaining to non-jurisdictional wetlands, Hart & Hickman’s Professional Wetland Scientists specialize in determining if wetlands on a property are considered non-jurisdictional under the conforming WOTUS rule.?Currently, non-adjacent wetlands, or wetlands with no continuous surface connection to a downgradient WOTUS, are considered non-jurisdictional.?
