Ahead of Stewarts’ submission to the CJC’s review of third-party #litigation funding, Risk and Funding Partner Julian Chamberlayne chaired a session concerning legal expenses #insurance in the CJC’s official consultation event at Pembroke College, Oxford University on 26 February 2025. This event also included discussion of damages-based agreements and conditional fee agreements, chaired by Mr Justice Simon Pickens; and regulation third party funding, chaired by John Sorajbi (both members of the CJC working group). The panellists for the session chaired by Julian were Rocco Pirozzolo, Greg Callus and Ray Koh. The issues addressed included approaches to broadening access to and use of legal expenses insurance, specifically before the event (BTE) insurance, whether and how a mandatory BTE insurance scheme might work, and what is needed to expand the use of legal expenses insurance. Julian comments: “The CJC’s broad ranging review is an opportunity to refine the fee and funding options for litigants bringing claims in England and Wales to bolster access to justice for a wide variety of claimants and claims.?I would like to thank the CJC for inviting me to chair this session, the panellists for their presentations and all those who attended this event for their varied and well-considered viewpoints.” The full Stewarts response to the CJC review is available to read here: https://lnkd.in/e2qWFM2U
