"In Khalil’s case, the government is challenging the Southern District’s jurisdiction over the case, arguing that Khalil’s lawyers should have filed it in either New Jersey or Louisiana, where Khalil was detained at the time. Ted Frank, the director of the Hamilton Lincoln Law Institute, told the?Washington Free Beacon?that there is a strong argument for challenging the jurisdiction and that he would be 'surprised if the motion isn’t granted.'" ??HLLI in the News??? Bloomberg Law wrote about our case, Carlyle v. Akorn, Inc. "Counsel for?Akorn Inc.?investors must return $332,500 in attorneys’ fees for filing frivolous lawsuits against the now-defunct drugmaker seeking pre-merger disclosures, a federal court ruled. Judge?Thomas M. Durkin?said he would also consider requiring the lawyers to cite the finding in future merger-related demand letters and suits, to disclose their retainer agreements, and to disclose so-called mootness fees in similar suits. Durkin, of the US District Court for the Northern District of Illinois, issued the order Monday. Ted Frank, an attorney and frequent class action objector, sought to intervene in the six largely resolved proposed suits—five of them class actions—that had sought additional disclosures in Akorn’s proxy documents for its proposed merger with Fresenius Kabi AG. The merger fell apart before Akorn’s 2023?bankruptcy. ??HLLI in the News?? Ted Frank, our co-founder, was quoted in this The Times of Israel article by Luke Tress. "Distributing Hamas pamphlets could be grounds for deportation, said Ted Frank, senior attorney at the Hamilton Lincoln Law Institute, which has filed litigation against anti-Israel groups that have blocked traffic at US protests. “The pamphleting, at least under congressional law, says, ‘Yeah, deport for that,’ and the Biden administration could have done that, but they weren’t enforcing that law, so the Trump administration is enforcing that law,” Frank said. “Under the law, even just espousing support for Hamas is enough for deportation.” Frank added that voicing support for terrorist activities, and not a specific terror group, is grounds for deportation, according to the law’s wording, and there is also no difference under the law between having a green card or a student visa. ??HLLI in the News ?? Along with with Advancing American Freedom and Young America's Foundation we filed an amicus brief in Dubash v. City of Houston. The city of Houston says it can sidestep 1A protections by handing park?management to a private nonprofit. Foundation for Individual Rights and Expression wrote about it: "Young America’s Foundation, Hamilton Lincoln Law Institute, and Advancing American Freedom?explain that Houston cannot bypass its duty to protect free speech in its public spaces by granting oversight authority to a private third party. The brief also emphasizes the sweeping implications of the district court’s decision, including in the academic context where state universities are increasingly attempting to evade First Amendment protections by outsourcing park management to nominally private entities like student governments."
