Congratulations to Ryan McCarthy for a decisive trial victory Friday in Suffolk Superior Court.??In this case, the plaintiff alleged that she slipped and fell on a clear liquid in our defendant Hospital’s hallway due to no warning signs being posted. She sustained a torn meniscus of her left knee requiring surgery and alleged significant long-term damages as a result.??Attorney McCarthy argued persuasively that our client had no notice of any liquid on the floor, had proper policies and procedures in place for monitoring the hallways and that the plaintiff’s knee injury was pre-existing. The jury returned with a defense verdict after only two hours of deliberations. Job well done!

Some delayed but nonetheless hearty Congratulations on a few recent trial verdicts: First, congratulations to the trial team of Toby Bright and Donna Marcin for their recent trial victory in Suffolk Superior Court.??This case involved allegations that our client, a vascular surgeon, failed to properly manage an aortic aneurysm leading to a preventable rupture of the aneurysm. The defense demonstrated that the management decisions were fully appropriate, the rupture unpredictable, and the client was skilled in repairing the aneurysm even in the setting of a rupture. After five days of evidence, the jury returned a defense verdict in under 3 hours of deliberation. ? Second, after a long trial in Lowell Superior Court, congratulations to our trial team of Jim Wilkinson and Heidi Oh, who secured a defense verdict on behalf of our client, a primary care physician. This case involved an alleged failure to discuss and offer PSA testing, resulting in a delay in diagnosis of prostate cancer in a 65-year-old patient.?Through cross-examination of plaintiffs’ experts and extensive preparation of the defense case, Jim and Heidi were able to present evidence that the defendant met and exceeded the applicable standard of care, and that if a PSA test had been ordered, it would have made no difference in the plaintiff’s prostate cancer prognosis. Congratulations to the HMDR&S trial team of Jim Wilkinson and Teresa Farris who recently obtained a defense verdict on behalf of two ICU nurses following a month-long trial in Middlesex Superior Court in Woburn.??The case involved the management of a 26-year-old patient admitted to the ICU.??Plaintiff alleged that the defendant providers negligently discharged the patient without appropriate medications, failed to offer her the appropriate treatment on discharge, and failed to document events in the records.??The defendants denied any negligence or causation, and Attorney Wilkinson was able to demonstrate that the patient was provided with medications in hand when she left the hospital, had declined treatment, and that these matters were appropriately documented in the records.?After deliberations, the jury returned a verdict in favor of both defendants. Well done, Jim and Teresa, and congratulations to our defendants!

Congratulations to HMDR&S for a great day on Thursday, with two hard-fought trial victories that came within a half hour of each other, in two different Massachusetts Courthouses. First, in Worcester County.??After two weeks of trial, congratulations to the trial team of Bob Hamel, Jr. and Megan Kures.??In a case involving allegations concerning the management of a stroke in the Neuro ICU, resulting in the paralysis and death of a 35 year old, the Defense was able to demonstrate the thoughtful and thorough, standard of care treatment provided by their Defendant, a neurointensivist attending, resulting in a defense verdict returned by the jury on behalf of our client. Meanwhile, in Lowell, congratulations to the trial team of Donna Marcin and Toby Bright, where a Middlesex County jury returned a defense verdict in a case involved allegations that our client, a labor and delivery nurse, mismanaged the labor of a patient causing a severe neurological injury to the child. In this case, the Defense put on convincing evidence that the labor and delivery nurse acted wholly appropriately, and that the injury the child suffered was due to an unfortunate perinatal stroke which occurred before our client became involved in the patients’ care. Congratulations to all! Well done, team!

Please join me in congratulating Donna Marcin and Toby Bright on obtaining a well-earned Defense Verdict in Middlesex Superior Court. This case involved allegations that our client, a Thoracic Surgeon, failed to appreciate an increased risk of a complication during a diagnostic procedure. Through expert medical testimony, and strong cross examination, Donna and Toby were able to demonstrate to the jury that this patient was at no higher risk of complication but in fact experienced a rare and unforeseeable complication, to which our client responded appropriately intraoperatively and well within the accepted standard of care. After two weeks of trial, the jury returned a prompt and decisive verdict in favor of our client yesterday afternoon.

Please join me in congratulating Donna Marcin for obtaining a defense verdict on behalf of our defendant Nurse after three weeks of trial in Suffolk Superior Court.?The case involved the post-operative management of a child in the ICU.?The plaintiff alleged that the defendant providers failed to appropriately assess the child’s tachycardia, which ultimately caused her to suffer a cardiac arrest.?The specific claim against our Nurse was that she should have gone up the chain of command and relayed certain concerns to the attending physician.?In the Nurse’s defense, Donna presented evidence supporting the clinical decisions she made in managing this very complicated patient.?Additionally, Donna’s extremely effectively cross-examination of the plaintiff’s expert was key in allowing the jury to return a verdict in our client’s favor.?Again, congratulations, Donna, on this outstanding result!
