Today, Gupta Wessler principal Deepak Gupta argued before the U.S. Supreme Court on behalf of the plaintiffs in Nvidia v. Ohman. The Associated Press observed that the Court "seemed likely to keep alive a class-action lawsuit accusing Nvidia of misleading investors about its dependence on selling computer chips for the mining of volatile cryptocurrency." 关于我们
Gupta Wessler LLP is a national litigation boutique focused on the representation of plaintiffs and public interest clients in appeals and complex cases. We handle high-stakes controversies in the U.S. Supreme Court and courts across the country, approaching each matter with a fresh perspective, a bird’s-eye view of the law, and a strategic sense of how to frame the issues for success. We are go-to appellate advocates for trial lawyers nationwide, serving as a counterweight to the corporate dominance of the Supreme Court and appellate bar. We also run the Harvard Supreme Court Litigation Clinic. Through all of our efforts, we aim to help shape the law in ways that enhance justice and improve people’s lives.

Last week, our firm filed a petition for certiorari in the U.S. Supreme Court in?Louis v. Bluegreen. For hundreds of years, people subject to void contracts have been able to go to court to challenge the contract and get their money back. That’s particularly important for military service members, whom the Defense Department has found are often specifically targeted by predatory lenders. We're asking the Supreme Court to grant review so that when a company like Bluegreen targets someone like our client Private Louis with an illegal contract, they can at least get into court to fight it. https://lnkd.in/gewweMB4?

Our firm recently won a victory against forced arbitration in the New Mexico Supreme Court in?Sanchez v. United Debt Counselors LLC. Firm Principal Jennifer Bennett shared, “This decision makes it harder for companies that harm New Mexicans to enforce unconscionable arbitration clauses. That's a victory for consumers and workers across the state of New Mexico, who just want to be able to have their day in court."

Our founding principal, Deepak Gupta, is quoted in previews of the U.S. Supreme Court's upcoming term that appear in The New York Times, The Washington Post, The Los Angeles Times, USA Today, and NPR's Morning Edition, among other media outlets. In the New York Times: “The Supreme Court seems to be hitting the snooze button,” said?Deepak Gupta, a lawyer with Gupta Wessler who frequently appears before the justices. “We’ve gone from constitutional earthquakes to legal paper cuts. It’s as if the justices wanted a controversy cleanse heading into the election.” https://lnkd.in/er5JSzbz https://lnkd.in/ewwZD98V https://lnkd.in/e4reAT34 https://lnkd.in/eE_px9VK https://lnkd.in/eAxzHRsp

We're representing shareholders in a securities fraud case against Nvidia in the Supreme Court. Our side got a big boost this week, with amicus briefs filed by the U.S. Solicitor General; a bipartisan group of former SEC officials; civil procedure scholars; institutional investors; data experts; and the American Association for Justice, among others. Oral arguments in the case are set for Nov. 13, 2024.

Gupta Wessler is challenging an Uber-backed proposed ballot measure, which seeks to cap attorneys' contingency fees, at the Nevada Supreme Court. Deepak Gupta recently participated in an interview with Legal Dive, where he discussed Uber’s motives for the extreme move amid the mounting sexual assault lawsuits the company is facing from riders. Yesterday, we filed our brief in the U.S. Supreme Court in a case alleging that Nvidia and its CEO Jensen Huang committed securities fraud by concealing Nvidia’s risky sales of its computer chips to cryptocurrency miners. Deepak Gupta will argue the case on November 13 against Nvidia’s lawyer, Neal Katyal. This is a significant case about protecting investors’ right to access the courts.? ? Yesterday, we filed our brief in the U.S. Supreme Court in Stanley v. City of Sanford. We argue that our client, a retired firefighter, shouldn't be denied the right to sue over disability discrimination under the Americans with Disabilities Act just because she's a former employee.
