A contractor cannot be the public adjuster on a claim and cannot advertise itself as an insurance claims negotiator if it does not hold an adjusters’ license, the Texas Supreme Court decided in a case that could give support to other states that have put restrictions on public adjusters. https://lnkd.in/gXj8cknd

The Texas Supreme Court gets it right! The long-anticipated Stonewater Roofing vs. Texas Department of Insurance decision was just released by the Texas Supreme Court. The Court completely rejected Stonewater Roofing's argument that the Texas Public Adjuster Licensing Act is an unconstitutional restraint on free speech and due process rights. The court held: ~~~ "Stonewater failed to state cognizable First and Fourteenth Amendment speech and vagueness claims.?Because the trial court properly granted TDI’s Rule 91a dismissal motion, we reverse the court of appeals’ judgment and render judgment dismissing the case."? ~~~ By rendering judgment for the Texas Department of Insurance, the case is now completely resolved. Notably, the court provided a lengthy discussion of what constitutes both permissible and prohibited conduct by contractors when their projects involve insurance claims. The analysis is entirely consistent with our teachings on the issue. Really glad to see this outcome. It's the right result. Opinion attached.
