The government has released the next tranche of reforms following the Quality of Advice Review in draft form for consultation.?The previous tranche underwhelmed some. This tranche has two initiatives aimed specifically at super funds to enhance their flexibility to offer assistance to their members in the form of ‘targeted prompts’ and ‘collectively charged’ advice. The third initiative would apply more broadly, replacing statements of advice with ‘client advice records’. Luke Barrett, Head of Superannuation, has prepared this briefing on the proposed reforms.

On 20 March 2025, the ACCC published draft merger assessment guidelines for consultation. Elizabeth Avery, Simon Muys, Haidee Leung, Amy van Dongen and Felicity Lee outline the key shifts in the ACCC’s proposed analytical framework for assessing notified acquisitions under the new regime in Australia, including the application of the new ‘creating, strengthening and entrenching’ market power element of the substantial lessening of competition test and the ACCC’s proposed approach to novel theories of harm.
