On November 22, 2024, a federal jury in Newark, New Jersey, returned a favorable defense verdict for their client, acquitting him on six counts related to healthcare fraud and violations of the federal anti-kickback statute. The jury could not reach a verdict on the nine remaining counts. The government moved to dismiss the remaining counts on January 14, 2025. Bravo!

DOGE Plan to Cancel the U.S. Attorney’s Office Lease in Corpus Christi Reversed.?Jon Muschenheim Speaks with News Outlet Valley Central. The Department of Government Efficiency (DOGE) reversed its decision to cancel the U.S. Attorney’s Office lease in Corpus Christi after terminating it in February, a move that left federal prosecutors scrambling. After a week of uncertainty, DOGE decided to keep the lease, which houses about 20 assistant U.S. attorneys handling drug and immigration cases from Border Patrol checkpoints in South Texas. Former Assistant U.S. Attorney and Gregor Wynne Arney partner, Jon Muschenheim, said he doubted that closing the Corpus Christi office would save taxpayer money. “If we’re not going to have work from home and you’re going to eliminate the office space, they’re going to have to put those people somewhere,” Muschenheim said. “From small acorns, giant oaks grow, right? Attorney Michael J. Wynne, of Gregor Wynne Arney, PLLC, filed a Notice of Supplemental Authority with the United States District Court for the Southern District of Texas asking the Court to reconsider dismissal of his defendant’s case. The Notice was filed in light of the newly passed Foreign Extortion Prevention Act (FEPA), which shows that the receipt of bribes by foreign officials was explicitly not illegal prior to the new law. Potential abuse of the Foreign Corrupt Practices Act (FCPA) and the overexpansive and unpredictable application of the FCPA beyond its intended bounds has been brought to light by a wave of executive dismissals by the Trump administration. Michael wants to achieve recognition of his client’s argument by the judiciary and not simply a political dismissal of the charges. UPDATE: Important Victory in United States v. Chad Beene ? On November 22, 2024, a federal jury in Newark, New Jersey returned a favorable defense verdict for Gregor Wynne Arney client Chad Beene related to charges of healthcare fraud and violations of the federal anti-kickback statute. He was found not guilty on 6 counts and there was a hung jury on the remaining 9 counts. This outcome is particularly significant as acquittals in federal criminal white-collar cases, especially high-profile healthcare fraud trials, are rare. Overall, the government has a conviction rate of approximately 95 percent. The odds are increasingly stacked against the defense. Following the trial, the federal judge gave the government until January 15, 2025, to decide whether it would put Mr. Beene to trial again on the remaining 9 counts. We are pleased to report the government has given the Court formal notice that it will not re-try the remaining counts. This is a complete and unqualified victory for the defense on all 16 counts, including alleged conspiracy to commit health care fraud and conspiracy to violate the federal Anti-Kickback Act.
