The FTC has voted in favor of a final rule to prohibit employers from using non-compete clauses which could lead to significant changes in the hiring market. Overview: ?? The rule applies to any provisions in contracts that prevent workers from seeking new employment, with an exception for agreements made during business sales as well as exceptions amongst senior executives. ?Ruling is set to come into effect 120 days after publication, though legal challenges could delay its implementation. The effect on human capital? ?? The FTC said that banning noncompetes will increase worker earnings by up to $488 billion over the next decade and will lead to the creation of more than 8,500 new businesses each year. ?? A competitive hiring market: The banning of non competes will add fuel to an already competitive hiring market. Professionals will have freedom to move much more easily, employers retention efforts will be tested outside of current legally binding non competes. What’s next? Major business groups representing an array of industries have criticized the rule, saying noncompetes are a crucial way for companies to protect trade secrets and that they promote competitiveness. Ruling will be met with legal challenges and if struck down in federal court, non-compete legal oversight would revert to state law and the FTC would have to go back to the drawing board. We’ll be watching closely for further developments.
