#ICYMI: On March 11, the Tenth Circuit issued an appellate ruling upholding the dismissal of a Title VII lawsuit that claimed a DEI training created a hostile work environment. This ruling is just the tip of the iceberg, and courts around the country are expected to weigh in on similar issues in the near future. Kevin Owen, partner at Gilbert Employment Law, spoke to The National Law Journal about the recent decision, noting that the training material and glossary terms cited in the complaint are not the norm in all DEI workshops.? Specifically, Mr. Owen told The National Law Journal, that he would “be cautious in assuming that any DEI training automatically leads to a finding of racial animus.”? The case highlights the importance of employers working with counsel to vet materials for DEI programs and initiatives. Read more about the case here: https://bit.ly/3TvUN3L

On March 12, 2024, we honored Equal Pay Day, a day that is selected to symbolize how far into the year women must work to earn what men earned the previous year.? On June 10, 1963, President John F. Kennedy signed the #EqualPayAct into law. This landmark legislation required that all individuals in the same workplace be given equal pay for equal work, regardless of their gender.? It’s been 61 years since this law took effect, yet women from every corner of the country still bear the brunt of the gender wage gap – especially women of color.? According to an analysis by Pew Research Center (https://pewrsr.ch/3x4ltky) women earned an average of 82 cents for every dollar earned by men in 2022. Since 2005, Gilbert Employment Law has handled all types of gender-related workplace disputes and has advocated on behalf of employees at every organizational level nationwide. We believe that every individual, regardless of their gender, deserves a workplace free from discrimination. That’s why we remain steadfast in our fight for pay parity and a more just, equitable workplace for all. If you are facing inequity in the workplace, contact our office today: https://bit.ly/3TIuIzF #EqualPay #GenderPayGap #Discrimination

As anyone in Washington, D.C. knows, the District’s 911 call and dispatch center has been plagued with critical failures. We are proud to represent Cleo Subido, the former interim director of the Washington, D.C. Office of Unified Communications (OUC), who fought to address these issues, improve transparency at the agency – and was fired because of it. Read Ms. Subido’s recent interview with ABC about the issues at the District’s 911 call and dispatch center, and about the retaliation she experienced here: https://bit.ly/3TyxZ4M Speaking up about or reporting your employer’s wrongdoing should never place a target on your back. Here at GEL, we understand that brave and ethical action can be risky and we never stop fighting for our clients in pursuit of the justice they deserve.
