In California, it was previously established in the courts that a joint labor-management cooperation committee could bring an action in court against a direct contractor of a private construction project for wage violations committed by its subcontractors. Now, that right has been codified into law with AB 2696, which amended Section 218.8 of the California Labor Code. The recent fires in Los Angeles were among the most destructive in California’s history, with more than 15,000 buildings damaged or destroyed and over 57,000 acres burned. It is no wonder that disaster declarations at the state and local swiftly followed—but what do those mean other than stating the obvious? The purpose is to expedite the rebuilding of homes and businesses in Los Angeles and Ventura Counties. The state-level declarations mean that for properties and facilities located in substantially the same location and not exceeding 110% of the footprint and height of the structures they replace, typically strict requirements under the California Environmental Quality Act and California Coastal Act have been suspended. The time limitations for Penal Code Section 396 (b) and (c) have also been extended to January 7, 2026, to protect victims of the fire from price gouging.
