I love it when we can see the full life-cycle of problem statement, technical solutions, scientific understanding, and policy recommendations. A ripped from the headline story of AI-powered voice scams led to the development of new techniques to detect AI-generated voices (Sarah Barrington, Romit Barua and Gautham Koorma) which then led to a scientific study to determine how well people can distinguish real from AI-generated voices (Emily Cooper). And most recently, a dinner conversation with law professor Rebecca Wexler led to a policy recommendation published today in Lawfare. Under the current Federal Rules of Evidence, someone trying to introduce an audio recording of a voice can satisfy the authentication standard for admissibility merely by putting a witness on the stand who says they are familiar with the person’s voice and the recording sounds like them. The rule presumes that this evidence will be “sufficient to support a finding that the item is what the proponent claims it is.” In the age of artificial intelligence, this presumption is no longer tenable. The Evidence Rulemaking Committee should amend the evidentiary rules to make the introduction of auditory evidence permissive, not mandatory.
