If you’re in New Jersey—or much of the country, for that matter—you’re probably bundled up against the deep freeze. But no matter the weather, the topic of divorce is always a hot one. When most people think about divorce, they picture hiring an attorney, their spouse hiring an attorney, and the two attorneys duking it out in court. This idea has been ingrained in society for years, but it’s simply not the only option—or even the best one—for most people. There are alternatives that save time, money, and emotional energy. One of the best alternatives to traditional divorce litigation is mediation. Mediation involves a neutral third party—preferably an attorney experienced in divorce law—who helps you and your spouse come to an agreement. The mediator walks you through all the necessary issues, from parenting schedules to financial matters, ensuring you reach a total agreement. The beauty of mediation? You don’t even need an attorney to participate. Many couples approach mediators without having retained legal representation, ready to work through the process collaboratively. For the majority of couples—especially those with W-2 jobs, minimal disputes over children, and shared assets like a home and retirement accounts—mediation is an excellent solution. It’s straightforward, cost-effective, and avoids the adversarial nature of litigation. For couples who have simply grown apart, mediation is often the most practical and effective way to move forward. You don’t need to spend thousands on attorney retainers before attempting to work out an agreement with your spouse. Even couples who don’t particularly like each other can successfully mediate. As long as both parties are committed to the process, mediation can be transformative. In fact, I’ve found that about 80% of couples can resolve all their issues in just three hours or less of mediation. The reason? Once you start discussing the issues—perhaps in a way you haven’t in years—you often realize you’re in agreement on more than you thought. For example: "We agree on the parenting schedule." "That issue isn’t that important to me, so I’ll let them have it." Before you know it, you’ve worked through 90% of the matters and only need to focus on resolving a small handful of disagreements. Here’s the hard truth: The average divorce costs between $15,000 and $16,000 per spouse. That’s over $30,000 for the average couple—money that could be better spent on your children’s education, a down payment on a new home, or even starting fresh. In contrast, mediation costs a fraction of that amount. Instead of months of litigation and endless attorney fees, mediation allows couples to focus on what’s fair and equitable, without unnecessary complications or expenses.
