Last week was another WIN against a predatory adult entertainment industry and I’m grateful my expert testimony helped. The TX legislature passed SB 315 in the 87th legislative session which increased the age to work at sexually-oriented businesses to 21 years old to protect the state’s interest in preventing human trafficking. The law was challenged by the adult entertainment industry on constitutional grounds that it violated the 1st and 14th Amendments. The Court ruled solidly in favor of the State. Among other important elements of the opinion, the Court states: “… the State has demonstrated a connection between the statute and the government's interest in combatting human trafficking.” Both Florida and Texas have passed this legislation, and it has now withstood constitutional scrutiny.
