The Fifth Circuit has issued an expedited appeal in the Corporate Transparency Act (“Act”) case under review from the Texas federal district court. The briefing will occur in February, and the court has scheduled an oral argument on March 25, 2025. Among the issues to be determined by the Court is the constitutionality of the Act.

On December 26, 2024, the merits panel of the United States Court of Appeals for the Fifth Circuit issued an order effectively reinstating the District Court's nationwide injunction of the Corporate Transparency Act. As a result, filers are not obligated to comply with the statute at this time but may file voluntarily.
